The SBA transferred the cases after internal reviews found inconsistencies between borrower submissions on payroll, employee counts, and business existence and the data later reported to the IRS. The agency stated that the IRS will now assess additional taxes, interest, and potential fraud penalties. This follows the 2023 SBA estimate that up to 20 percent of the $1.2 trillion in pandemic relief may have been obtained fraudulently.

Government Accountability Office data from April 2024 placed annual federal fraud losses between $233 billion and $521 billion, indicating that pandemic programs exposed systemic weaknesses in verification rather than isolated errors. The current administration has since referred 562,000 delinquent loans to Treasury for collection and permanently barred 870,000 individuals from future federal lending after they were linked to $39 billion in suspected fraud.

Prior SBA leadership did not execute mandatory referrals of past-due debts, allowing the backlog to accumulate. The shift reflects a change in enforcement priority driven by documented non-compliance rather than new legislative authority.

IRS matching will determine the scale of tax adjustments and whether criminal referrals follow. Treasury collection actions are expected to accelerate once the IRS completes its initial reviews of the flagged $100 billion portfolio.
