California AB 1262 mandates upload of state driver's license records to federal database

The bill requires the California DMV to transmit full license records including photographs, biometrics, addresses, and driving history to the federal system administered by DHS. This exceeds minimum REAL ID data-sharing rules that previously limited transmission to verification queries. State records show 27 million active licenses will be eligible for bulk transfer once regulations are finalized in 2026.

Prior uploads occurred in 12 states under 2018-2023 pilot programs, with DHS reporting 4.2 million daily queries across participating jurisdictions in its 2024 annual system audit. California data volume will increase total records by 19 percent. No statutory limit restricts secondary use by federal agencies or retention periods.

The change integrates state DMV infrastructure directly into the national identity verification layer already used for air travel, firearms purchases, and banking. Existing state privacy statutes contain no override for federal database access once records are uploaded. Similar expansions in Texas and Florida produced sustained increases in cross-jurisdictional law enforcement lookups within 18 months of implementation.

DMV systems will begin schema mapping in Q4 2025. Full operational capability is scheduled for January 2027. Litigation from privacy organizations is expected before the transfer deadline.
